Typically, in San Diego you can evict a commercial tenant; however, it is not as easy as just changing the locks to the property. A commercial lease eviction occurs when a landlord wants to remove their tenant from a piece of commercial property. In order to do this, specific steps need to be taken. Before you can seek an unlawful detainer, you have to give notice to your tenant and wait out the time-frame in that notice. If the tenant fails to get back into compliance with the lease, you may then go to the courts for an order allowing the sheriff to evict your tenant. However, in the midst of the COVID-19 pandemic, there are new regulations in place that may prevent a landlord from completing the eviction process at this time. In order to ensure you properly follow the court requirements, it is highly suggested that you speak with a skilled attorney to assist you with this process.
