Obtaining a fair settlement for a car accident in California is a complex task. Many of the California automobile insurance carriers have computer programs that they use to determine what they will offer. Just because a computer program, developed by the insurance company, makes an evaluation and offer, does not mean that it is a fair offer. It is important for consumers to know that they do not have to agree with the settlement offer that comes to them from the insurance company. Very often, the ultimate jury verdict is 10 times greater than the amount offered by the insurance company. In addition, just the filing of a lawsuit and the beginning phases of litigation move the settlement evaluation process to another level in the insurance company. This means that there is a middle ground between having to accept the insurance company’s offer and going to trial. The middle ground often takes places in a mediation that includes you, the client, your own plaintiff’s lawyer and the defense lawyer hired by the insurance company. If you have a first-rate plaintiff’s lawyer, this amount will typically be far greater than any amount offered as an initial settlement proposal.
